1. Agreement

1. Sözleşme

These Terms of Use (“Terms”) are a contract between you and the operator of Omi (“Omi”, “we”, “us”) for the iOS app with bundle ID live.omega.app and related servers. By tapping Continue with Apple or Google, completing onboarding, or using Omi, you agree to these Terms and to the Privacy Policy.

Bu Kullanım Koşulları (“Koşullar”), seninle Omi (“Omi”, “biz”) işletmecisi arasında, bundle ID’si live.omega.app olan iOS uygulaması ve ilgili sunucular içindir. Apple veya Google ile devam ederek, kaydı tamamlayarak veya Omi’yi kullanarak bu Koşulları ve Gizlilik Politikasını kabul etmiş olursun.

If you do not agree, do not create an account and delete the app. If you decline the in-app community rules, you must stop using Omi.

Kabul etmiyorsan hesap açma ve uygulamayı sil. Uygulama içi topluluk kurallarını reddedersen Omi’yi kullanmayı bırakmalısın.

2. The service

2. Hizmet

Omi is a live video chat app for adults. You create a profile, see people who are online, send or receive a video invite, and talk face to face. Omi is not a dating app, not an escort service, and not a marketplace. We do not promise romance, meetings in real life, or that any particular person will accept your invite.

Features include: Explore cards, incoming invites, optional gender/country/language filters (some filters require Omi Pro), profile photos, optional face verification, block and report, and Omi Pro subscriptions. Features described as coming soon (for example extra tabs) are not part of the current contract until they ship.

We may change, suspend, or discontinue any part of Omi, including who appears in Explore, invite limits, and moderation models. We will try not to break paid Pro access without a reasonable path to restore or refund through Apple where required.

Omi’nin herhangi bir kısmını, Keşfet’te kimlerin göründüğü, davet limitleri ve moderasyon modelleri dahil, değiştirebilir, askıya alabilir veya durdurabiliriz. Ücretli Pro erişimini, Apple’ın gerektirdiği yerde geri yükleme veya iade yolu olmadan bozmamaya çalışırız.

You must be able to form a binding contract under the laws of your country. You may not use Omi if you are prohibited from receiving the service under applicable export or sanctions rules.

4. Accounts

You sign in with Apple or Google. We do not issue a separate Omi password. You are responsible for activity on your account and for keeping access to that Apple ID or Google account secure.

• One person, one account. We may bind your account to an app-generated device identifier to reduce multi-accounting.
• Usernames must be 3–20 characters (letters, numbers, underscore) and must pass safety review. Sexual, hateful, or abusive names are rejected.
• You must accept the community rules before using Explore and video chat.
• You may log out at any time. You may delete your account in Settings. Deletion is permanent for profile, photos, username, and login, as described in the Privacy Policy.
• We may refuse, suspend, or terminate an account that violates these Terms, even without prior notice in serious cases (underage, sexual exploitation, threats, illegal content).

• Bir kişi, bir hesap. Çoklu hesabı azaltmak için hesabını uygulamanın ürettiği cihaz kimliğine bağlayabiliriz.
• Kullanıcı adı 3–20 karakter (harf, rakam, alt çizgi) olmalı ve güvenlik incelemesinden geçmelidir. Cinsel, nefret içeren veya hakaret adlar reddedilir.
• Keşfet ve görüntülü sohbeti kullanmadan önce topluluk kurallarını kabul etmelisin.
• İstediğin an çıkış yapabilirsin. Ayarlar’dan hesabını silebilirsin. Silme; profil, fotoğraf, kullanıcı adı ve giriş için Gizlilik Politikasında açıklandığı gibi kalıcıdır.
• Bu Koşulları ihlal eden hesabı reddedebilir, askıya alabilir veya sonlandırabiliriz; ciddi durumlarda (reşit olmama, cinsel sömürü, tehdit, yasa dışı içerik) önceden haber vermeden de.

5. License to use Omi

5. Omi’yi kullanma lisansı

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Omi app on an Apple device you own or control, as permitted by the App Store Terms. You may not copy, reverse engineer (except where the law forbids that restriction), rent, scrape at scale, or use Omi to build a competing live-chat dataset.

Sana, App Store Koşullarının izin verdiği şekilde, sahip olduğun veya kontrol ettiğin bir Apple cihazında Omi uygulamasını kullanman için kişisel, sınırlı, geri alınabilir, münhasır olmayan, devredilemez bir lisans veririz. 6. Your content and our license

You keep ownership of your username, photos, and anything you say or show on a live call. You grant Omi a worldwide, non-exclusive, royalty-free license to host, compress, transmit, and display that content solely to operate the service (show your profile, deliver a live call, run safety review, and handle a report). This license ends when the content is deleted from our systems, except copies we must keep for legal or safety reasons.

Kullanıcı adının, fotoğraflarının ve canlı görüşmede söylediğin veya gösterdiğin şeylerin sahibi sensin. Omi’ye, yalnızca hizmeti işletmek için (profilini göstermek, canlı görüşmeyi iletmek, güvenlik incelemesi ve bildirim) bu içeriği barındırma, sıkıştırma, iletme ve görüntüleme konusunda dünya çapında, münhasır olmayan, telifsiz lisans verirsin. You represent that you have the right to upload each photo (including photos that show other adults who consented) and that the content does not infringe copyright, trademark, privacy, or publicity rights.

7. Community rules (required)

These rules are part of the contract. They match the rules you accept in the app. Breaking them can mean instant removal.

1. 18+ and real people. Only real people 18 or older. Fake accounts, catfishing as a child, and hiding your age are forbidden.
2. No sexual harassment. Unwanted sexual talk, flashing, genital exposure, pressure for sexual acts, or sending sexual imagery is forbidden and is grounds for a ban.
3. No inappropriate content. Nudity, pornography, sexual posing, fetish performance, graphic violence, gore, and hate symbols are forbidden. Profile photos are reviewed before they go live.
4. Be respectful. Insults, threats, doxxing, discrimination, and harassment are forbidden.
5. No illegal activity. Scams, fraud, sale of illegal goods, terrorism, or sexual content involving minors (including fictional or “looks under 18”) is forbidden. We will cooperate with law enforcement where required.
6. No spam. Ads, QR codes, or contact-harvesting as the main point of a profile or call are forbidden.
7. Report issues. If you see harassment or someone who looks underage, report it in the call or profile tools.
8. Block. You may block anyone you do not want to talk to. Do not try to evade a block with a second account.

2. Cinsel taciz yok. İstenmeyen cinsel konuşma, teşhircilik, cinsel organ gösterme, cinsel eyleme zorlama veya cinsel görsel göndermek yasaktır ve ban sebebidir.
3. Uygunsuz içerik yok. Çıplaklık, pornografi, cinsel poz, fetiş performans, ağır şiddet, kan ve nefret sembolleri yasaktır. Profil fotoğrafları yayına girmeden incelenir.
4. Saygılı ol. Hakaret, tehdit, doxxing, ayrımcılık ve taciz yasaktır.
5. Yasa dışı faaliyet yok. Dolandırıcılık, yasa dışı mal satışı, terör veya reşit olmayanları içeren cinsel içerik (kurgusal veya “18 altı gibi duran” dahil) yasaktır. Gerektiğinde kollukla işbirliği yaparız.
6. Spam yok. Profilin veya görüşmenin asıl amacı reklam, QR veya iletişim toplamak olamaz.
7. Sorun bildir. Taciz veya reşit değil gibi görünen biri görürsen görüşme veya profil araçlarından bildir.
8. Engelle. Konuşmak istemediğin herkesi engelleyebilirsin. Engeli ikinci hesapla aşmaya çalışma.

Automated filters are not perfect. You remain responsible for what you upload and what you do on camera. We may remove content that our review flags even if you disagree.

8. Report, block, and enforcement

Apple requires user-generated content apps to provide filtering, reporting, blocking, and a published contact method, and to act on reports. Omi provides:

• Username and photo filtering before publish.
• In-call and profile Report with reasons: sexual harassment, inappropriate content, hate or harassment, spam or scam, they look underage, or other. An optional screenshot may be stored for review.
• Block, which stops invites both ways.

We aim to review objectionable-content reports within 24 hours and to remove content or accounts that violate these Terms. We may ban without a warning for severe harm. Appeals can be sent to the same email; we are not required to reinstate any account.

İtiraz edilen içerik bildirimlerini 24 saat içinde incelemeyi ve bu Koşulları ihlal eden içerik veya hesapları kaldırmayı hedefleriz. Ağır zarar için uyarı olmadan banleyebiliriz. İtiraz aynı e-postaya yazılabilir; herhangi bir hesabı geri açmak zorunda değiliz.

9. Live video rules

• You must not record, stream onward, or publish a call or another user’s face or voice without a lawful basis and their consent.
• You must not demand sexual content. You must end the chat if the other person is uncomfortable or asks you to stop.
• You must leave immediately if you believe the other person is under 18, then report them.
• Omi does not keep a library of live calls. A still image may be kept only if attached to a safety report.
• Video quality depends on your network, device, and LiveKit. We do not guarantee uninterrupted calls.

• Hukuki dayanak ve rıza olmadan görüşmeyi, başka birinin yüzünü veya sesini kaydedemez, başka yere yayınlayamaz veya yayımlayamazsın.
• Cinsel içerik dayatamazsın. Karşı taraf rahatsızsa veya durmanı istiyorsa sohbeti bitirmelisin.
• Karşı tarafın 18 yaşından küçük olduğunu düşünüyorsan hemen ayrıl ve bildir.
• Omi canlı görüşme arşivi tutmaz. Durağan görüntü yalnızca güvenlik bildirimine eklenirse saklanabilir.
• Görüntü kalitesi ağın, cihazın ve LiveKit’e bağlıdır. Kesintisiz görüşme garanti etmeyiz.

10. Omi Pro subscriptions (Apple)

Free accounts may send a limited number of video invites (currently 5). After that, inviting requires Omi Pro. Pro may also include a badge, extra reach, and paid Explore filters (gender, country, language other than “All”). We may change free limits; existing paid periods will still receive the Pro features described at purchase time as far as reasonably possible.

10.1 Auto-renewable subscriptions (App Store required disclosure)

Prices are shown in the app in your App Store local currency and may include tax. Any unused portion of a free trial, if we offer one later, is forfeited when you buy a subscription. Restore Purchases is available on the paywall. Refunds are requested through Apple (reportaproblem.apple.com), not through Omi.

Fiyatlar uygulamada App Store yerel para biriminle gösterilir ve vergi içerebilir. İleride deneme sunarsak, kullanılmayan deneme kısmı abonelik alınca düşer. Satın almayı geri yükle paywall’da vardır. İadeler Omi üzerinden değil Apple üzerinden istenir (reportaproblem.apple.com).

If a purchase fails to unlock Pro, use Restore Purchase or email us with the Apple transaction date. We do not sell coins, loot boxes, or randomized paid items.

11. Verified profiles

Verification is optional. You need at least three profile photos and a live selfie. A match is an automated similarity check, not a government ID check and not a guarantee the person is safe. We may remove a verified badge if photos change or a report is upheld.

12. Intellectual property

Omi, the OMI wordmark, icons, and the app’s design are our intellectual property or our licensors’. You may not use them except to run the official app. If you believe content on Omi infringes your copyright, email onurkaplan35@gmail.com with the URL or username, a description of the work, and a statement that you are the owner or authorized agent. We will remove or disable access to infringing material where appropriate.

Omi, OMI yazısı, ikonlar ve uygulamanın tasarımı bizim veya lisans verenlerimizin fikri mülkiyetidir. Resmi uygulamayı çalıştırmak dışında kullanamazsın. Omi’deki bir içeriğin telifini ihlal ettiğini düşünüyorsan onurkaplan35@gmail.com adresine URL veya kullanıcı adı, eserin tanımı ve sahip veya yetkili vekil olduğuna dair beyanla yaz. Uygunsa ihlal materyalini kaldırır veya erişimi kapatırız.

13. Disclaimers

OMI IS PROVIDED “AS IS” AND “AS AVAILABLE”. Other users are strangers. We do not background-check users. We do not guarantee that verification, photo review, or reports will catch every lie, underage user, or crime. You use live video at your own risk. Meet offline only if you independently decide to, and never send money to someone you met on Omi.

OMI “OLDUĞU GİBİ” VE “MEVCUT OLDUĞU ŞEKLİYLE” SUNULUR. Diğer kullanıcılar yabancıdır. Kullanıcıları arka plan kontrolünden geçirmeyiz. Doğrulama, fotoğraf incelemesi veya bildirimlerin her yalanı, reşit olmayanı veya suçu yakalayacağını garanti etmeyiz. Canlı görüntüyü kendi riskinle kullanırsın. Çevrimdışı buluşma yalnızca kendi kararınladır; Omi’de tanıştığın birine para gönderme.

To the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers; those limits apply only as far as the law allows. Your consumer rights under Turkish consumer law or EU consumer law are not excluded where they cannot be excluded.

Kanunun izin verdiği ölçüde zımni ticarilik, belirli amaca uygunluk ve ihlal etmeme garantilerini reddederiz. Bazı hukuk düzenleri belirli redleri kabul etmez; o sınırlar yalnızca kanunun izin verdiği kadar geçerlidir. Türk tüketici hukuku veya AB tüketici hukuku kapsamındaki, vazgeçilemeyen hakların dışlanmaz.

14. Limitation of liability

To the maximum extent permitted by law, Omi and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of Omi, other users’ conduct, downtime, or moderation decisions.

Kanunun izin verdiği ölçüde Omi ve işletmecileri; Omi kullanımı, diğer kullanıcıların davranışları, kesinti veya moderasyon kararlarından doğan dolaylı, arızi, özel, sonuçsal veya cezai zararlardan, kâr, veri veya itibar kaybından sorumlu değildir.

Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid to Apple for Omi Pro in the 12 months before the claim or (b) USD 50 (or local equivalent). This does not limit liability that the law says cannot be limited (for example, death or personal injury caused by our proven gross negligence, where that rule applies).

Hizmete ilişkin herhangi bir talepte toplam sorumluluğumuz (a) talepten önceki 12 ayda Omi Pro için Apple’a ödediğin tutar ile (b) 50 ABD doları (veya yerel karşılığı) arasından büyük olanıyla sınırlıdır. Kanunun sınırlanamayacağını söylediği sorumluluk (örneğin, uygulandığı yerde kanıtlanmış ağır ihmalimizden doğan ölüm veya yaralanma) bu maddeyle sınırlanmaz.

15. Indemnity

You will defend and indemnify Omi against claims arising from your content, your live conduct, your violation of these Terms, or your violation of law, except to the extent a claim is caused by our willful misconduct.

İçeriğin, canlı davranışın, bu Koşulları veya hukuku ihlalinizden doğan taleplere karşı Omi’yi savunur ve tazmin edersin; talebin bizim kasten kötü niyetimizden doğduğu ölçüde hariç.

16. Apple-required terms

You acknowledge that these Terms are between you and Omi, not with Apple. Apple is not responsible for the app or its content. Omi, not Apple, is responsible for addressing claims relating to the app, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws.

Bu Koşulların seninle Omi arasında olduğunu, Apple ile olmadığını kabul edersin. Uygulamadan veya içeriğinden Apple sorumlu değildir. Uygulamayla ilgili talepleri (ürün sorumluluğu, yasal veya düzenleyici bir gerekliliğe uymama, tüketici koruma, gizlilik veya benzeri yasalardan doğan talepler) Apple değil Omi karşılar.

In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if you paid Apple for the app itself). To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Intellectual-property infringement claims relating to the app are Omi’s responsibility, not Apple’s.

Uygulama geçerli bir garantiye uymazsa Apple’ı bilgilendirebilirsin; Apple, uygulamanın kendisi için Apple’a ödeme yaptıysan satın alma bedelini iade eder. You represent that you are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

ABD hükümeti ambargosuna tabi bir ülkede veya “teröre destek” olarak belirlenmiş bir ülkede bulunmadığını ve ABD hükümetinin yasaklı veya kısıtlı taraflar listesinde olmadığını beyan edersin.

You must comply with applicable third-party terms when using Omi (for example your wireless data agreement). Apple and Apple’s subsidiaries are third-party beneficiaries of this section and may enforce it against you. Questions, complaints, and claims about the app should be directed to onurkaplan35@gmail.com, not to Apple.

Omi’yi kullanırken geçerli üçüncü taraf koşullarına uymalısın (ör. mobil veri sözleşmen). Apple ve Apple’ın bağlı şirketleri bu maddenin üçüncü taraf lehtarlarıdır ve bunu sana karşı ileri sürebilir. 17. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, except that mandatory consumer-protection laws of your country of residence still apply if they cannot be waived. Courts of Istanbul, Türkiye have exclusive jurisdiction for disputes that are not required to stay in your local consumer courts.

Bu Koşullar, kanunlar ihtilafı kuralları uygulanmaksızın Türkiye Cumhuriyeti hukukuna tabidir; ikamet ettiğin ülkenin vazgeçilemeyen zorunlu tüketici koruma kanunları saklıdır. Yerel tüketici mahkemelerinde kalması zorunlu olmayan uyuşmazlıklarda İstanbul, Türkiye mahkemeleri münhasır yetkilidir.

If a court finds any part of these Terms unenforceable, the rest stays in force. We may assign this contract in connection with a sale of the service. You may not assign it without our consent.

Bir mahkeme bu Koşulların bir kısmını uygulanamaz bulursa geri kalanı yürürlükte kalır. Hizmetin satışıyla bağlantılı olarak bu sözleşmeyi devredebiliriz. Sen, onayımız olmadan devredemezsin.

18. Changes and contact

18. Değişiklikler ve iletişim

We may update these Terms. The “Last updated” date will change. If a change is material, we will surface it in the app when we can. Continued use after the new Terms take effect is acceptance, except where the law requires a new consent. If you do not agree, delete your account and stop using Omi.

Bu Koşulları güncelleyebiliriz. “Son güncelleme” tarihi değişir. Değişiklik önemliyse mümkün olduğunda uygulamada gösteririz. Yeni Koşullar yürürlüğe girdikten sonra kullanmaya devam etmek, kanun yeni rıza istemedikçe kabul sayılır. Kabul etmiyorsan hesabını sil ve Omi’yi bırak.
